1. Who we are
These terms apply to all bookings and services provided by Simon Paesen, performing as SIMÒN, a self-employed DJ and music producer based in Hasselt, Belgium.
2. Scope
SIMÒN provides DJ performances and related services for clubs, festivals, private events and other bookings, as agreed between SIMÒN and the client (the person or organisation booking the performance).
3. Bookings & confirmation
A booking request submitted through simonmusic.be or by email is not binding until confirmed in writing by SIMÒN and the deposit described below has been received. Once confirmed, the booking is considered final on both sides, subject to the cancellation terms in Section 5.
4. Payment
A deposit of 50% of the agreed fee is due to confirm the booking. The remaining balance is due within 7 days after the performance, unless otherwise agreed in writing.
5. Cancellation
If the client cancels a confirmed booking, the deposit is retained and the remaining balance is not due. This reflects that the date was reserved and other bookings for that date may have been declined.
If SIMÒN needs to cancel a confirmed booking, reasonable efforts will be made to arrange a suitable replacement act. If no replacement can be arranged, any amounts already paid by the client will be refunded in full.
6. Technical requirements
For performances requiring a venue-provided setup, the minimum technical requirements outlined in the technical rider apply. The client is responsible for ensuring these are met, or for discussing any limitations with SIMÒN in advance.
7. Liability
SIMÒN is not liable for indirect or consequential damages, including but not limited to loss of income, arising from a performance, except in cases of intent or gross negligence. SIMÒN is not responsible for equipment, sound systems or facilities provided by the venue or client.
8. Force majeure
Neither party is liable for failure to perform obligations due to circumstances beyond reasonable control, including illness, accidents, extreme weather, or other events preventing the performance from taking place as planned.
9. Photo & video use
Unless otherwise agreed in writing, SIMÒN may use photos, video or audio recordings from a performance for portfolio and promotional purposes, including on simonmusic.be and social media.
10. Governing law
These terms are governed by Belgian law. In the event of a dispute that cannot be resolved amicably, the courts of Limburg, Belgium have jurisdiction.
